Chileans who are born in Chile do not lose their Chilean nationality by becoming citizens in a foreign country, unless they voluntarily renounce it before a competent Chilean authority. It should be noted that this renunciation must be preceded by a nationalization in a foreign country. By competent Chilean authority, we refer to the Chilean consulate, if the interested party is abroad, or the Servicio Nacional de Migraciones, if the person is in Chile. According to the constitutional text, those who lose their nationality by virtue of Article 11 may only be reinstated by law.
Request for the elimination of annotations due to the loss of Chilean nationality
Chileans who have lost their Chilean nationality because they were nationalized in a foreign country under the text of the Constitution prior to Law 20.050 (published in the Official Gazette on August 26, 2005), and who have an annotation for the loss of Chilean nationality in their birth registration, may request the elimination of such annotation.
If they are abroad, they may make the request before the respective consular authority. If they are in Chile, before the Servicio Nacional de Migraciones: Must present the Birth Certificate where the registration of the renunciation is recorded.
The referred request will be sent to the Servicio de Registro Civil e Identificación, in order to proceed to the elimination of this annotation.
